CLICK-O-MANIA.COM MEMBERSHIP AGREEMENT.
This agreement describes the entire terms and conditions for participation in the Click-O-Mania membership program. In this agreement, the term "member" refers to you (the applicant). Whenever the agreement refers to "you" or "your", it means "member", "we" or "our" refers to Click-O-Mania.com owners of the Click-O-Mania membership program.
ELIGIBILITY
An individual becomes a Click-O-Mania member by completing and submitting the online membership enrollment form. The member must be of legal age to participate in the state, province or country in which they reside. Each individual may only maintain one Membership at a time.
COST
Membership is FREE. All members may take advantage of our affiliate program. There is no cost to become an affiliate. If a member or affiliate wishes to use the e-mail service to send mail to a list they will be charged the same fee as our advertisers.
CUSTOMERS
Individuals who become Click-O-Mania members are deemed to be customers of Click-O-Mania.com accordingly, all Click-O-Mania rules, policies, and operating procedures concerning customer orders, customer and service will apply to those customers.
RELATIONSHIP OF PARTIES
Click-O-Mania and the Member are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between parties. You will have no authority to make or accept any offers or representations on our behalf. Click-O-Mania members are expressly prohibited from stating or implying, orally or in writing, that they are franchises, joint venture partners, partners, or employees of Click-O-Mania.com . Click-O-Mania members have no authority to speak on behalf of Click-O-Mania.com.
LIMITATION OF LIABILITY
We will not be liable for indirect, special, or consequential damages(or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages.
COMMUNICATION
Click-O-Mania is an internet based program and therefore uses e-mail and internet web pages as communication devices. All Click-O-Mania members must have a valid e-mail address and must notify Click-O-Mania if that address changes. This can lead to loss of affiliates, but the balance will be transferred to the new account. Any information posted on our website or emailed to the Member's e-mail address of record is considered delivered to the Member.
UNCOMMISSIONABLE EMAIL
E-mail updates and notices are not commissionable. They are for notification and to inform our database of updates, enhancments, communication, and customer service. Also, any resend for merchants due to malfunction or misfortune is not commissionable.
ADVERTISING
Members may advertise their Click-O-Mania member site using any of the advertising banners, links or material produced by Click-O-Mania and made available on our website. No one may use the Click-O-Mania name or logo on any materials not produced by Click-O-Mania without written permission from Click-O-Mania. Click-O-Mania members are prohibited from granting media interviews regarding Click-O-Mania, without prior written approval from the Click-O-Mania.com staff.
UNSOLICITED COMMERCIAL EMAIL
(SPAM) Click-O-Mania is in no way participates in mass unsolicited e-mailing (i.e. spamming), and all Members are expected to adhere to this policy as well. Violation of this policy will result in termination of this contract, and immediate dismissal from the Click-O-Mania membership program, with no refund.
TERRITORIES
There are no territory exclusives in the Click-O-Mania membership program.
TERMINATION
Any Member who wishes to terminate their status may do so by sending a mail to the adress posted on the site. Memebership cancelations are updated once a week. Cancelation or termination of any Click-O-Mania membership results in the permanent loss of the rights to his or her organization.But, member's accounts shall be non-interest bearing. Accounts...shall
not be payable until the minimum
account balance of fifty dollars ($50.00) has been reached.
DISCLAIMERS
We make no express or implied warranties or representations with respect to the Membership Program or your potential to earn income from the membership program. In addition, we make no representation that the operation of our site or the Click-O-Mania sites will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.
INCOME CLAIMS
Click-O-Mania members are expressly prohibited from making any representations regarding the income potential of the Program.
AMENDMENTS
Click-O-Mania may amend this Agreement, its prices, and its sales, marketing, and commission plan at any time. Amendments will be communicated by posting them on the Click-O-Mania website or by e-mail. Amendments are effective and binding upon being published on the website or upon the sending of an e-mail notification.
